Probate and Administration of Estates
We understand that dealing with bereavement is an extremely emotional time. We offer a personal service founded on many years of experience in Probate and Administration of Estates. Whether you are looking for advice in your capacity as an Executor or you would like us to apply for Probate of the Will or Letters of Administration we are available to assist.

We:

  • Provide you with a dedicated and experienced probate solicitor to work on your matter
  • Identify the legally appointed executors or administrators and beneficiaries
  • Accurately identify the type Probate application you will require
  • Obtain the relevant documents required to make the application
  • Complete the Probate Application and the relevant HMRC forms
  • Draft a legal oath for you to swear
  • Make the application to the Probate Court on your behalf
  • Obtain the Probate and securely send two copies to you
  • Collect and distribute all assets in the estate

Incapacity
Lasting Powers of Attorney are signed when the donor has mental capacity to manage his or her own affairs, but continue to be valid even if that ceases to be the case.

We have extensive knowledge and experience in this area and our team is always willing to advise on the best way forward for you.

If you are unwell and unable to come to our offices, we can make the arrangements to visit you at home. Alternatively, you could provide us with your instructions in a letter and we will do the rest.

Storage Services

We are happy to store original Wills and Lasting Powers of Attorney at our secure off site facility at no cost to you. However, if you require us to retrieve any such documentation we will make a charge of £40 plus VAT (the “charge”) for our services in doing so. This covers the cost of retrieval and either meeting with you to hand over documentation or to forward the same to you by recorded delivery. The charge will be levied at the time of making your request and can be paid by debit/credit card over the telephone.

James joined our Private Client Department in 2022 having qualified as a Solicitor in 2011.  James specialises in Wills, Probate and Estate administration, Powers of Attorney, Trusts and Tax Planning.  James works with clients in a friendly and approachable manner when dealing with matters of a sensitive and personal nature so as to relieve the pressure and burden placed on clients. .

Rebecca Shepherd is a full-time secretary in the Wills, Probate and Trust Department who has over six years' experience in Private Client work.
